Didn’t Ask Him to Marry” in Rape Case Bail Plea: Chief Justice Clarified

“We did not ask him (rape accused) to marry. We asked, ‘are you going to marry?’ We did not say ‘marry’,”

New Delhi: On March 1, the supreme court was hearing the bail request of Mohit Subhash Chavan, accused of raping a schoolgirl. He faced charges under the Protection of Children from Sexual Offences law.

While arguing the Chief Justice S A Bobde asks, “If you want to marry, we can help you. If not, you lose your job and go to jail. You seduced the girl, raped her. We are not forcing you. Later you may say court forced you,”

The judge remarks drew an angry criticism from several quarters as it was interpreted as the top court considering marriage as some remedy for rape. 5,000 people signed a petition asking that he even resign and quit. Multiple women’s rights activists, eminent citizens, intellectuals, writers, and artists sent a letter to Chief Justice asking an apology and a retraction of his remarks.

Today Chief Justice of India, S A Bobde, clarified and said the comments he made during a hearing of a rape case last week was completely misreported. “We did not ask him (rape accused) to marry. We asked, ‘are you going to marry?’ We did not say ‘marry’,”

Solicitor General Tushar Mehta, also, said the court had asked the question in a different context.
