Sharjeel Imam Granted Bail by Delhi High Court in Sedition, UAPA Case

New Delhi: The Delhi High Court has granted statutory bail to activist Sharjeel Imam in a sedition and Unlawful Activities Prevention Act (UAPA) case related to his speeches in Delhi’s Jamia area and Aligarh Muslim University (AMU). A Division Bench of Justices Suresh Kumar Kait and Manoj Jain made the decision considering Imam has already served half of the sentence applicable to the invoked offenses.

Despite this bail, Imam remains in jail due to his involvement in a larger conspiracy case linked to the 2020 Delhi riots. He was initially arrested on January 28, 2020, and sought bail on the grounds that he had spent four years in jail out of a maximum seven-year sentence. Furthermore, he argued that the sedition charge had been put on hold by the Supreme Court, and the UAPA charges did not exceed a seven-year sentence.

The trial court had previously denied him bail, stating that while his speeches against the Citizenship Amendment Act (CAA) did not directly incite violence, they significantly influenced public mobilization, which led to the Delhi riots. The judge noted that Imam’s speeches inspired disruptive activities that escalated into widespread violence and considerable damage to public property.
