Vehicles Seize in Drunk Driving Case are Illegal: Telangana High Court

The judge made it clear that provisions of the Motor Vehicles Act and the other governing provisions do not permit the seizure of the vehicle.

Hyderabad: The Telangana High Court has directed the police not to seize vehicles when the drivers are caught driving under influence of alcohol and made it clear that any violation of the above directions can be considered as contempt of court. The judge made it clear that provisions of the Motor Vehicles Act and the other governing provisions do not permit the seizure of the vehicle.

Justice K Lakshman of the Telangana High Court was hearing and disposing of a batch of 40 petitions on the issue. The court said that if the vehicle driver was found to be drunk while driving the vehicle, the police should allow his friends and relatives with a valid driving license to drive the car home. Only if they don’t find any persons, the police should temporarily take possession of the vehicle and release the vehicle to the owner or any authorized person on production of the Registration Certificate (RC) of the seized vehicle.
