Muslim Law Allows Minor Girls to Marry on Attaining Puberty: Punjab & Haryana High Court

Article 195 of the Muslim Personal Law which states Muslim women can enter marriage contract with their person of choice on attaining puberty.

Chandigarh: The Punjab and Haryana high court has said that a Muslim girl who reached puberty but still less than 18 years old, has right to marry as per Muslim personal law.

High court judgment was referring to Article 195 from the book “Principles of Mohammedan Law” and the literature on Muslim marriages and various judgments by courts in India.

Article 195 of the Muslim Personal Law which states Muslim women can enter marriage contract with their person of choice on attaining puberty.

The High court observed that a Muslim girl, on attaining the age of puberty, is capable to enter into a marriage contract with a person of her choice.

The order was passed by Justice Alka Sarin on a petition filed by a Muslim couple (a man aged 36 and woman aged 17) from Punjab, who noted that the couple “cannot be deprived of their fundamental rights because their family members were against the marriage”.
